TERMS OF SERVICE

1. ACCEPTANCE OF TERMS

By using our services, bringing equipment to our facility, requesting repairs,
or communicating with us regarding our services, you (“Customer” or “you”)
automatically agree to be bound by these Terms of Service (“Terms”).
Your use of our services constitutes acceptance of these Terms.
If you do not agree to these Terms, please do not use our services.

2. SERVICES PROVIDED

Nerd Base One provides computer repair, diagnostic, maintenance,
data recovery, mobile device repair (phones, tablets), and related
technical services for personal computers, laptops, mobile devices,
and associated hardware (“Services”).

3. SMS MESSAGING AND COMMUNICATIONS

3.1 We may send SMS text messages to communicate about
your repair status, appointment reminders, and service updates.

3.2 Customers are responsible for all SMS/text messaging charges that may be
incurred on their mobile device. Nerd Base One is not responsible for any charges
from your wireless carrier, including but not limited to SMS fees, data charges, or
overage fees.

3.3 Message
frequency varies. Message and data rates may apply. You may opt out of SMS
communications at any time by replying “STOP” to any message.

4. STREAMING AND EDUCATIONAL CONTENT

4.1 Nerd Base One reserves the right to stream, record, or broadcast repair processes
for educational and demonstration purposes.

4.2 Privacy Protection: Any streaming or recording will focus solely on hardware
components and troubleshooting techniques. We will NOT display, record, or stream:
• Computer screens or monitor displays
• Personal files or data
• Personally identifiable information
• Serial numbers or identifying marks
• Any content that could identify the customer or their data

4.3 By
using our services, you consent to the potential streaming of hardware repair
processes as described above.

5. MOBILE DEVICE REPAIR RISKS (PHONES, TABLETS, ETC.)

5.1 Screen
and Glass Damage Risk: Mobile device repairs often require disassembly that may
result in damage to screens, glass, digitizers, or other fragile components. 
You acknowledge and accept the risk that accessing your device’s internal
components may cause:
• Cracking or shattering of screens or glass
• Damage to LCD/OLED displays
• Digitizer or touch functionality failure
• Cosmetic damage to device housing

5.2 Discovery of Additional Damage: Upon opening your mobile device,
we may discover pre-existing internal damage not visible during initial
inspection, including but not limited to:
• Water damage or corrosion
• Previously damaged internal components
• Worn or failing parts
• Manufacturing defects

5.3 Battery Hazards: Mobile device batteries may pose safety risks during repair,
including:
• Battery swelling or “puffing” that may damage other internal components
• Battery ignition or thermal events that may cause fire, smoke, or
chemical damage to the device and surrounding components
• Toxic fume release
• Complete device destruction

5.4 Chain Reaction Damage: Nerd Base One is not liable for cascading or chain
reaction damage that occurs when one failing component causes damage to
other parts of your device. We are here to help repair your device, not to
assume liability for the consequences of pre-existing damage or component
failures.

5.5 Mobile Device Repair Disclaimer: BY REQUESTING MOBILE DEVICE REPAIR
SERVICES, YOU ACKNOWLEDGE AND ACCEPT ALL RISKS associated with
device disassembly, component access, and potential component failures,
including total device loss.

6. DATA BACKUP, RECOVERY, AND LOSS LIABILITY

6.1 Customer Data Backup Responsibility: You are solely responsible for maintaining
current backups of your data. By using our services, you acknowledge that you have
failed to maintain adequate backups of your data.

6.2 Failing Drive Data Recovery: When attempting data recovery or backup services on
failing, damaged, or corrupted storage devices:
• We are not liable for any data loss that occurs during recovery attempts
• Failing drives may completely fail during recovery processes
• You assume all risk of total data loss when requesting data recovery services
• Our data recovery efforts are provided as a courtesy service with no
guarantee of success

6.3 No Data Recovery Guarantee: Nerd Base One makes no warranty or guarantee
that any data can be recovered from failing or damaged storage devices. All data
recovery attempts are performed at your own risk.

6.4 Pre-existing Damage: We are not responsible for data loss from storage devices
that were already failing, damaged, or corrupted when brought to us, even if the failure
becomes complete during our service attempts.

7. LIABILITY AND WARRANTIES

7.1 Limitation of Liability: Nerd Base One’s liability shall not exceed the amount
paid for services. We are not liable for indirect, incidental, or consequential
damages, including but not limited to lost data, lost profits, or business interruption.

7.2 Hardware
Risks: Computer and mobile device repair involves inherent risks. While we
exercise reasonable care, we cannot guarantee against all possible hardware
failures or complications.

7.3 Data
Loss Disclaimer: NERD BASE ONE IS NOT RESPONSIBLE FOR ANY DATA LOSS,
regardless of cause, including but not limited to hardware failure, software
corruption, or complications arising during repair or recovery attempts.

8.
CUSTOMER RESPONSIBILITIES

8.1 Provide
accurate contact information and device passwords when necessary.

8.2 Remove
or disclose any security software that may interfere with diagnostics.

8.3 Retrieve
repaired equipment within 30 days of completion notice.

8.4 Acknowledge
the risks associated with repair and data recovery services.

9. PAYMENT TERMS

9.1 Payment
is due upon completion of services unless other arrangements are made
in writing.

9.2 Diagnostic fees apply even if you decline repair services.

9.3 Data recovery attempt fees apply even if no data is successfully recovered.

9.4 Unclaimed equipment after 30 days may be subject to storage fees or disposal.

10.
PRIVACY AND DATA HANDLING

10.1 We respect your privacy and will not intentionally access personal files unless
necessary for repair or recovery.

10.2 We recommend removing sensitive data before service when possible.

10.3 Any data accessed during repair will be kept confidential and not disclosed to
third parties.

11. WARRANTY

11.1 We provide a 90-day warranty on labor under normal use conditions & will re do
 any services paid for.

11.1.2 New hardware comes with a 1 year warranty

11.1.3 Refurbished hardware come with a 90 day warranty

11.2 Warranty on parts does not cover damage from customer misuse, accidents,
or unrelated hardware 
failures, unless additional warranty coverage is purchased
that specifically covers it.

11.3 Warranty is provided on data recovery services or failing storage devices if
we backed up data to our servers, we may retain data for 90 days in case
customers lose their data during this period, in accordance with our privacy policy.

11.4 Mobile device repairs carry additional warranty limitations due to the fragile
nature of components and potential for cascading failures.

12. FORCE MAJEURE

Nerd Base One is not liable for delays or failures due to circumstances beyond
our  control, including but not limited to natural disasters, power outages,
or supply chain disruptions.

13.
DISPUTE RESOLUTION

Any disputes shall be resolved through binding arbitration in accordance
with the laws of Texas.

14.
MODIFICATIONS

Nerd Base One reserves the right to modify these Terms at any time.
Updated Terms will be posted at our location and on our website.

15. SEVERABILITY

If any provision of these Terms is found unenforceable, the remaining
provisions shall remain in full force and effect.
